Please read these Terms and Conditions ("Terms") carefully before using the Spectra Blades website (the "Service") operated by Spectra Blades ("us," "we," or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Products & Services

  • Product Descriptions: We strive to display the colors and images of our products as accurately as possible. However, we cannot guarantee that your screen's display of any color will be accurate. We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction.

  • Custom Commissions: All custom and bespoke product commissions are subject to a separate agreement, a non-refundable deposit, and are final sale. The design, specifications, and timeline will be confirmed in writing before work begins.

  • Pricing: We reserve the right to change product prices at any time without notice. All orders are subject to stock availability.

2. Orders & Account

  • Order Acceptance: Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to refuse any order you place with us.

  • Account Security: If you create an account on our Service, you are responsible for maintaining the security of your account and password. You agree to accept responsibility for all activities that occur under your account.

3. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Spectra Blades and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Spectra Blades. This includes, but is not limited to, the name "Spectra Blades," our logo, and all related graphics and product designs.

4. Acceptable Use

You agree not to use the Service:

  • For any unlawful purpose.

  • To solicit others to perform or participate in any unlawful acts.

  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others.

  • To harass, abuse, insult, harm, defame, or discriminate.

  • To submit false or misleading information.

5. Product Use & Safety

WARNING: OUR PRODUCTS ARE NOT TOYS. THEY ARE HIGH-ENERGY COLLECTIBLES AND DISPLAY ITEMS.

  • Safety Acknowledgement: By purchasing a Spectra Blade, you acknowledge and agree that it is a sophisticated device that can cause injury or property damage if misused. The plasma blade emitter can generate significant heat and light.

  • Safe Handling: You agree to use the product responsibly, in a safe and open environment, away from flammable materials and fragile objects.

  • Liability: You assume all risks and liability for any damage, loss, or injury resulting from the misuse, modification, or improper handling of our products. Spectra Blades is not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our products.

  • Age Restriction: You must be 18 years or older to purchase a Spectra Blade. By placing an order, you confirm you are of legal age.

6. Shipping & Delivery

  • Title and Risk: Title to the products and risk of loss passes to you upon our delivery of the items to the carrier. You are responsible for filing any claims with the carrier for damaged or lost shipments.

  • Delivery Delays: We are not responsible for delays in delivery that are due to force majeure events or the fault of the shipping carrier.

Please refer to our separate Return & Refund Policy for detailed information, which is incorporated into these Terms by reference.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Spectra Blades shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or goodwill, resulting from your access to or use of, or inability to access or use, the Service or any products purchased through the service.

9. Indemnification

You agree to defend, indemnify, and hold harmless Spectra Blades and its licensees and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt, resulting from or arising out of a) your use and access of the Service, or b) your breach of these Terms, including but not limited to the Product Use & Safety section.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
